Position Summary: This attorney position is a Civil Litigator in the Civil Enforcement Bureau within the Medicaid Fraud Control Unit in Tallahassee or Miami, Florida. The incumbent represents the State of Florida in all Medicaid Fraud Cases and handles settlement negotiations, pleadings, depositions, pre-trial, jury, and non-jury trials, and post-trial and appellate practice related to MFCU cases. Pay: $98,262.06 Annually. Qualifications: Admission to the Florida Bar and two (2) years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. The required legal experience must be from the practice of law in a state or territory of the United States. Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class. NOTE: Effective 6/13/2011, the OAG has modified its policy on assessing the level of work experience necessary to meet the minimum requirements for assistant attorney general and above. Applicants with certified legal intern experience will be credited on a month-to-month basis toward meeting the minimum experience requirement. Those with other legal intern experience will be credited on a month-to-month basis, up to a maximum of 3 months. The Work You Will Do: The responsibilities of this position include, but are not limited to the following: Represent the State of Florida in all Medicaid Fraud Cases, handle settlement negotiations, pleadings, depositions, pre-trial, jury and non-jury trials, post-trial and appellate practice related to MFCU cases. Research and draft motions, discovery responses, memoranda, briefs, opinions, orders, settlements, subpoenas and other miscellaneous pleadings and documents. Provide guidance and leadership to entry-level attorneys. Coordinate the investigation and litigation of MFCU cases. Exercise a thorough working knowledge of federal and state rules of procedure, evidence and substantive law. Provide MFCU investigators, analysts and auditors with legal advice and assistance related to MFCU investigations. Provide legal assistance to the Director with regard to MFCU matters. Perform routine administrative matters, including: attending staff meetings, providing case status reports, documenting case files, preparing travel vouchers, tracking time records, and filing documents, etc. Respond to public records requests. Requires the ability to research and work independently and may involve travel in and out of state. Maintain current expertise in areas of practice, including reading recent judicial decisions and case summaries and attending continuing legal education and other professional seminars.
